What recourse do I have with this guy and a deal gone bad?

Hey everybody
I recently joined here as I just bought my 1st Bronco. I’m not new to forums but do follow rules, help and contribute when I can and always use decorum and try to be polite. I recently negotiated a price on a used bestop soft top with twisted77 out of Evansville, Indiana. I sent payment via paypal and was told by him he’d send it in a week or so. I waited the week and then, out of the blue, get a PM from him stating he would not be sending the top and would be refunding my payment. No explanation, no headsup. Nothing.
Now, I’ve done hundreds of transactions online via ebay, craigslist and other forums and I would never behave like this. He has chosen to not answer any of my messages to him. My guess is he found someone else that offered more $$$. This is his last message to me: “Buy the one with warranty from WH”
I guess that says it all.
My question to you is: What can I do and far as any recourse? Thanks in advance:(

F him, what I would do is call him out online and trash his name......I think the last line of his message says it all. Buy the one with warranty from wh....I think the last message from you was about a warranty and could you get your money back if you didn't like it. He didn't want to bother. That's just my take. There is no recourse, buy the one from wh. No problem...

As long as you get your money back than all is good. Maybe he did get a better offer or maybe he found out there was something wrong with the item and didnt want to sell you a crappy item. He might have opened it up to find a mouse chewed a small hole in it or maybe the windows were all cratched up. I would never buy any item without looking at it first (unless is was less than $50). I dont care if its on this forum, ebay, or another online auction site or forum, i will never spend more than $50 bucks on a used item i have never seen in person or had another person look at for me. Sometimes we just get sick of a bunch of questions about a item and decide it not worth the effort to sell it anymore. I have ran into tons of that with CL guys.

Get your money back and move on. This might be a blessing in disguise????

I bought a pair of slots from twisted77 about 3 months ago...He is a super nice guy, but was swamped with work after I sent payment through paypal. After a week he sent me a message stating that he felt bad that he had not gotten around to sending the slots and offered to refund my money. I insisted that I really wanted the slots and to send them when he could...He kept his word and sent them shortly after.

My take is that he just couldn't find the time to send your top and felt bad?

NWA4X, I'm not sure what recourse you're looking for, but there really isn't any. He's either going to sell you the top or he isn't. Now if he had taken your money and disappeared then that would be something different.

Although it may not be very cool to back out at the last minute, in my experience there are 2 sides to every story (at least 2) so I'd give the benefit of the doubt and wait to hear his side.

Yes, of course I'll let it go and move on. I can't let something this insignificant bother me too much. What I don't understand is why he took my payment and after more than a week, promised me he'd send it and then without any explanation, just refund it and walk away like it was nothing. There aren't too many sides to this story. I bought something and the seller didn't follow through with his side of the bargain. Thanks for all your opinions and thoughts. Much appreciated! ;D

I can only speak for what I have seen myself, and I've done a trade with him, spoke on the phone several times and met him in person, and feel I came out fine on our deal, and that he was a really nice guy. He even brought me more parts than I had asked for.

I think you got a right to be annoyed if I understand things correctly. But he didn't take your money and run, and while it's quite irregular, sounds like things were made as right as could be, if your going to back out of a deal. In general though doing that is a bad practice.

Perhaps he had a reason for this, and maybe he will explain it, although I don't think that he should have to on a public forum if he doesn't want to.

I did not just say I'm refunding your money. Let's get real here and tell the whole truth. If you would like I can cut and paste every thing I have sent. I to you with my new job I can't get to ship during the week and can't tell about the weekend till its here. You where fairly perturbed when it wasn't sent last sat even though I had told you it would be the next week. So with me not knowing when I could get it out to you I thought it be best to give a full refund of all money. I don't have it sold locally. Or to anyone else. If you would like to attest anything I have written like I said I will be glad to copy and paste anything you or I have said in my in or outbox.

Sounds like Nowax is a little pushy and demanding!!! Treating a seller like he is Amazon.com and should have your item in the mail in five minutes deserves a canceled sale. 77 was likely picturing the whining that would ensue when you got the top and don't blame him one bit. You're coming on here and flaming him simply confirms his suspicions. Learn from this Nowax!

x2 on letting it pass, like Cracker said. We're all on here looking for "deals" and since this isn't a primary business for most of us, sometimes things don't line up like we'd like.

I had one back and forth where I was the seller of a manual steering box for $65 shipped. After 4 polite messages explaining everything from where my Bronco had "grown up" to $60 is by bottom price, I was told to F-off by this jerk. I think he deserved a good flaming but, like Cracker said, we try to do better than that here. I simply put him on my "ignore" list and moved on.

Considering all the good experiences I've had here buying selling, and getting build advice, I figured the good outweighs the bad.

I know Twisted, he isn't the kind of guy to take advantage. Yes life is busy and things happen. Sounds like he was fair.

NWA4X, By you naming the guy in the first post, I already took it as you were flaming him. At least you got your money back! %) When you get a chance look what saddleup did to a bunch of guys on here.
